burning an hour south of denver. the shaded area shows the fire taking over colorado springs. it has moved into neighborhoods like this one, burning down homes and of the flying w ranch. the heat and flames are still too intense for a full damage assessment. a giant cloud of smoke hangs over colorado springs. flames have forced more than 32,000 residents to leave their homes and even the u.s. air force academy is being evacuated >> we're facing a potentially devastating disaster right now and we're well prepared and working through things a >> the fire doubled in size overnight to more than 15,000 a.. the mayor's office estimates dozens of homes are destroyed but the fire is still too intense for an official count. bright yellow and orange flames indicate another home has been lost >> we will get through this

together and we will be stronger because of the experience. >> the command post here is giving 1000 firefighters their marching orders. more crews and engines are on their way to help and are more fires burning in the state. authorities believe lightning started the flagstaff fire near boulder. thousands of are on standby to evacuate. the largest of the fires is the hyde park wild fire. one woman was killed and more than to under 50 homes have been destroyed >> things have got really bad. i don't remember ever seeing vegetation this dry >> thunderstorms are expected in the colorado springs area today but crews are concerned it could bring unpredictable winds. >> president obama will be in colorado on friday touring the damage from the walled canyon fire >> a trio of small fires came

uncomfortably close to homes in contra costa county today. pg&e thinks that a bird on a power line started the first one. those fires started just before noon about 1 mi. apart. one crept within about 700 ft. of homes. fire crews had both of them out within an hour. 82 alarm fire erupted in a moment creek. it burned right up to several backyards but no property damage was reported. this is a frightening reminder of just how quickly a fire can get going. pallet fire crews are on high alert but with the state strapped for cash, fires are not their only worries. they're also concerned about potential cost-cutting. >> we wouldn't be able to get to the fire as quickly >> if it is your house and a fire is impinging on it or if it was your kids out there, he

would certainly want immediate response. >> in addition to trucks, bulldozers and other, pallet fire also has 22 airplanes but that is to cover the entire state. hundreds of pounds of illegal commercial great fireworks. >> that is really scary that they had that much >> two men were arrested, 400- 500 lbs. of explosives were confiscated. investigators say they received a tip that the two men owned and were selling large amounts of explosives. chopper 5 is live over the scene of a standoff in san leandro. alameda county sheriff's are surrounding this apartment complex on mateo street in ashland. they're looking for a gunman

they say they spotted running into the complex after shooting another man. the victim is in the hospital in critical condition. no word on a motive. >> questions about jury tampering this morning put a halt to the trial for william lynch, the man accused of beating up a priest he says molested him as a child. len ramirez has more from the court >> in a case that has had many twists and turns already, a new one today, a possible case of jury tampering and speculation that a spectator may have somehow slipped into the off- limits jury assembly room. two hours into proceedings today, the judge abruptly and mysteriously stopped the trial and cleared the courtroom >> it was very unusual this morning. the jury remained in the courtroom but the dow was cleared. it was very confusing to us. there seems to be something

strange things going on >> the judge never explained what happened but it could have been a potential case of jury tampering. the jurors, the judge warned onlookers to stay out of the room and to avoid conversations with the jurors. mary eaton was on the witness stand, she was working at a retirement home the day the defendant william lynch allegedly beat father gerald wigner. she testified she saw lynch beating a retired priest. that's in contrast to her police statement that she did not see the attack. in cross-examination by defense attorney got her to admit that part of her job was to protect the reputation of the priests >> the thing she did a fine job of being willing to say whatever it took to fulfill that mission >> the court will be taking a pre scheduled day off tomorrow. on friday is expected that the prosecution will rest its case

>> cost-cutting is exactly the reason the east contra costa county fire district is putting out a call for help. john ramose reports it is looking for volunteers to help get through what could be a long

season. >> about 2000 people live on bethel island in east contra costa county but come sunday, a few of them will be missing. a fire station is shutting down. >> the level of service we're providing on saturday vs. sun. will be drastically different >> the district is lane off half its firefighters in closing half its stations. response times will likely increase to remote places but voters were warned about that when they voted down a parcel tax. now the fire chief has a new task. >> find out the interest of people that would be willing to volunteer in become a volunteer firefighters >> the idea of a volunteer force is not new to the area. they had won 30 years ago. >> when a call went out everyone would run out of the bars or whatever and the volunteers were right there >> he admits he didn't think they had much training back then

but that is not true today. the district will require volunteers to have 240 hours of fire training, 60 hours of medical training, 100 hours of engine driving training, and 240 hours of training during the year. the training could take six months to complete. will they have difficulty finding people? >> i don't think so. there are enough guys around, i think we could scrape a crew together. it would be a shaky looking bunch but we could do it >> if you have a fire at 3 in the morning and you need to be commuting at 5:00 a.m. to get to the city to work at 7, how will that work? >> only time will tell. if the same voters who spoke out against taxes will answer the call to volunteer. >> the oakland mayor is expecting full responsibility

for her fall to 100 blocks plan but she said she was given wrong information to begin with >> i'm not a researcher, i don't do all my own research. i will take full responsibility for the error of using that particular statistic >> the mayor says that even though the numbers are wrong, crime-fighting plan is still a good one. before today the mayor said repeatedly that almost all the shootings and murders happened in the 100 blocks. one week ago her chief of staff admitted that is not right >> stockton is set to become the latest and largest american city to file for bankruptcy protection. city leaders approve the financial steps last night, paving the way for chapter 9. the plan would effectively plug next year's deficit. city lawyers have until friday to file the paperwork in court. any time now governor brown could sign the state budget. it includes cuts to welfare and

social services and assumes that voters will approve the governor's tax hike in november. >> some bay area cities are taking a closer look at portland. that city has taken a bold step by dramatically reducing its garbage picked up to only twice per month. how it works and those who say a whole idea stinks. >> the president here at the marin sanitary service willie does look like a week of every other week picked up, it would save the money and reduced their carbon footprint but she is not completely sold. >> coffers of conservation, earth, our mission and our job >> it is not only their model, patty is passionate about reducing her company's carbon footprint >> to be one of the first independent haulers to actually

programs in california and oregon is that we live under much more of a regulatory environment >> it would take some effort to change state law which mandates weekly pickup of smelly waste. patty is also concerned her customers would not go for it. >> we live in such an affluent highly dependent on a convenience throwaway society. we just have to muslin volume to go every other week >> she has not run out the idea completely. >> it is something you typically see a cat to but this time firefighters had to rescue a dog that was stuck up a tree. how he got there in the first place >> it is the first diet drug to get approved in more than a decade but some doctors are concerned.

rejected the drug out of concern in part it might damage heart valves. now it says it is satisfied the drug will not cause such problems but the safest way >> the only way to do it is hard work. you need to watch your diet, eat less, and exercise more. >> sutter struggled with her weight since going off the pill >> i started feeling hungry again and started gaining back all the weight that i had lost >> it is not clear when the drug will be available or what it will cost. the average weight loss is modest. most patients lost on average 6% compared to 3% taking a placebo. sixth post marketing studies must be conducted to look for any long-term side effects which is key because millions of people may take it. >> i'm seeing flashbacks to other diet drugs that have harmful side effects >> they have been troubled track

record. >> mobile 5 is live at the alameda county fairgrounds tonight. volunteers are helping in an effort to pack 100,000 kids against hundred meals in case of disaster. the meals will be stored at the fair grounds which happen to be a state regional disaster recovery area. the volunteers say it is a nice way for them to give back and have a little bit of fun. live pictures out of phoenix arizona, this is a dust storm moving through the area and it is huge. to thousand feet high and reportedly 10-50 mi. wide. there was another one in that area just yesterday >> node dust storms in our forecast but some changes are coming >> there are changes coming. we will be looking for things to begin to cool down as we head towards the weekend and temperatures warmed up today by a couple of degrees.

satellite radar showing that low pressure is developing off the pacific northwest. things look like they will be very nice for tomorrow and it will be sunny and warmer. what is interesting about phoenix is that at the same time they have the dust wind an advisory, they also have warnings for all the moisture in the atmosphere which is producing a good deal of rain in parts of eastern arizona. that's why, it is outflow from a thunderstorm that is kicking up surface wind, an indication that parts are boiling as they anticipate more thunderstorms to form. a few low clouds along the shoreline, the sunshine in the afternoon for the bay area. this is what it looks like now,

mostly clear around the bay area but look at sunrise, low clouds form and then they clear off. low clouds in the morning, clearing in the afternoon. tomorrow we look for plenty of sun. upper '70's along the shoreline. for tomorrow, we will be looking for a northern california to be sunny and warm along the coastline. it temperatures in the mid-60s around the beach. the '80s for the far east end up in the north bay we will be looking at numbers in the upper 70's and low 80s. we will cool down for the weekend but nothing dramatic. discover british columbia.

scaled 30 ft. up a tree on the peninsula. mike sugarman shows us these firefighters rushed to the rescue after the terrified dog realized it could not get down >> firefighters have a dangerous job and they're trying to put out a fire. sometimes they need to rescue a cat out of a tree. last week menlo park firefighters rescued a dog. a year-old pianist once climbed that big oak tree about 20 ft. and was able to get down but when he began chasing iraq and, he forgot that dogs don't climb trees and was stopped about five stories up. blogs we talked with express surprise. >> i can't believe he got so high >> said that dog. >> i know that guy

>> said pete >> what is he doing up there? >> that breed was originally bred to hunt vermin so he must have won with his instincts >> she is a menlo park bob walker, the only person we could find to talk about the story. firefighters were not available and guinness and his owner did not want to comment. in an answer to the most asked question about this story, yes, it was a slow news day. >> buying tickets online for sporting and entertainment events can be tricky especially when several website sell tickets to the same event. it is easy to overpay on look- alike web sites >> it says san jose center for the performing arts >> but as he found out appearances can be deceiving.

last month the grandfather wanted to buy tickets to marry popped and so he did a global search. >> he gave me the impression it was the official site >> it turned out it was not. instead of being a site with a direct relationship to the theater, he stumbled upon an unauthorized ticket reseller or a third-party seller, something he didn't realize until a few days later >> they were fedex from omaha nebraska >> and he paid more than 2.5 times the ticket price >> >> cnet bryan cooley says that third-party sellers know how to work the search engine system to get their links to the top of the list and once they're there, consumers also often assumed it is the official seller. as a result, it is not hard to click on one that is not the official site that has a reasonable name.
